Dekrit Presiden 5 Juli 1955 dan Isinya

Peristiwa yang mendorong keluarnya dekrit presiden adalah tidak berhasilnya Sidang Konstituante menetapkan Undang-Undang Dasar. Penyelenggaraan Pemilu I tanggal 29 September 1955 (untuk memilih anggota DPR) dan tanggal 15 Desember 1955 (untuk memilih anggota konstituante) tidak dapat mengatasi kondisi Negara yang labil akibat pergolakan di daerah-daerah. Pemilu ini dilaksanakan berdasarkan Konstitusi RIS dan UUD 1945 yang dirancang dan disusun oleh pemimpin-pemimpin bangsa Indonesia waktu itu.
Anggota DPR yang terdiri dari puluhan wakil partai terpecah-pecah dalam berbgai ideologi yang sukar disatukan. Sementara itu, di kalangan masyarakat, sangat kuat gerakan dalam demontrasi dan petisi untuk menuntut diberlakukannya kembali UUD 1945.
Menyikapi keadaan, Presiden Soekarno pada tanggal 25 April 1959 menyampaikan amanat kepada Konstituante yang isinya anjuran kepala Negara dan kepala pemerintahan untuk kembali ke UUD 1945.
Sidang Konstituante yang menyikapi amanat presiden tersebut menyepakati untuk melaksanakan pemungutan suara untuk menetapkan UUU1945 menjadi UU Republik Indonesia. Sidang yang dilaksanakan 30 Mei 1959, mayoritas menghendaki kembali kepada UUD 1945. Namun, jumlah suara ini tidak memenuhi ketentuan dua pertiga dari jumlah suara yang masuk sebagaimana ketentuan UUDS 1950. Sidang selanjutnya tanggal 1 dan 2 Juni 1959 juga gagal mencapai dua pertiga.
Dalam keadaan yang demikian, Penguasa Perang Pusat melarang kegiatan politik. Larangan ini tertuang dalam peraturan Nomor PRT/PEPERLU/040/1959, tanggal 3 Juni 1959. Dampak dari larangan ini, Konstituante menjadi reses. Dalam keadaaan yang masih tak menentu, beberapa fraksi menyatakan tidak akan menghadiri siding selanjutnya.
Situasi keamanan Negara dalam kondisi gawat, pemberontakan-pemberontakan daerah terus terjadi.
Dengan tujuan untuk menciptakan ketatanegaraan, menjaga persatuan dan keselamatan Negara, Nusa dan Bangsa, serta keberlangsungan pembangunan semesta menuju mnasyarakat adil dan makmur, Presiden Soekarno mengeluarkan dekrit.

Dekrit Dengan Rahmat Tuhan Yang Maha Esa KAMI PRESIDEN REPUBLIK INDONESIA/PANGLIMA TERTINGGI ANGKATAN PERANG Dengan ini menyatakan dengan khidmat : Bahwa anjuran Presiden dan Pemerintah untuk kembali kepada Undang-Undang Dasar 1945 yang disampaikan kepada segenap rakyat Indonesia dengan amanat Presiden pada tanggal 22 April 1959 tidak memperoleh keputusan dari Konstituante sebagaimana ditentukan dalam Undang-Undang Dasar Sementara; Bahwa berhubung dengan pernyataan sebagian besar anggota-anggota Sidang Pembuat Undang-Undang Dasar untuk tidak lagi menghadiri siding. Konstituante tidak mungkin lagi menyelesaikan tugas yang dipercayakan oleh rakyat kepadanya; Bahwa hal yang demikian menimbulkan keadaan keadaan ketatanegaraan yang membahayakan persatuan dan keselamatan Negara, Nusa, dan Bangsa, serta merintangi pembangunan semesta untuk mencapai masyarakat yang adil makmur; Bahwa dengan dukungan bagian terbesar rakyat Indonesia dan didorong oleh keyakinan kami sendiri, kami terpaksa menempuh satu-satunya jalan untuk menyelamatkan Negara Proklamasi; Bahwa kami berkeyakinan bahwa Piagam Jakarta tertanggal 22 Juni 1945 menjiwai Undang-Undang Dasar 1945 dan adlah merupakan suatu rangkaian kesatuan dengan Konstitusi tersebut, Maka atas dasar-dasar tersebut di atas, KAMI PRESIDEN REPUBLIK INDONESIA/PANGLIMA TERTINGGI ANGKATAN PERANG Menetapkan pembubaran Konstituante. Menetapkan Undang-Undang Dasar 1945 berlaku lagfi bagi segenap bangsa Indonesia dan seluruh tumpah darah Indonesia terhitung mulai hari tanggal penetapan dekrit ini dan tidak berlakunya lagi Undang-Undang Dasar Sementara. Pembentukan Majelis Permusyawaratan Rakyat Sementara, yang terdiri atas anggota-anggota Dewan Perwakilan Rakyat ditambah dengan utusan dari daerah-daerah dan golongan-golongan serta pembentukan Dewan Pertimbangan Agung Sementara akan diselenggarakan dalam waktu sesingkat-singkatnya. Ditetapkan di Jakarta Pada tanggal 5 Juli 1959 Atas nama Rakyat Indonesia Presiden Republik Indonesia/Panglima Tertinggi Angkatan Perang SOEKARNO

Dengan keluarnya dekrit presiden ini, pada tanggal 10 Juli 1959, Kabinet Djuanda dibubarkan. Selanjutnya, dibentuk kabinet baru yang perdana menterinya adalah presiden. Kabinet ini mempunyai tiga tugas pokok yaitu program sandang, pangan, keamanan dan penyelesaian Irian Barat.
